By accessing and using the services provided by Apex Solutions De Gestion ("Company," "we," "us," or "our"), you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not access or use our services.

Apex Solutions De Gestion provides professional property management services including but not limited to: - Residential and commercial property management - Tenant screening and relations - Rent collection and financial reporting - Property maintenance coordination - Lease administration The specific services provided to you will be outlined in your individual property management agreement.

As a user of our services, you agree to: - Provide accurate and complete information - Maintain the confidentiality of any account credentials - Notify us immediately of any unauthorized use of your account - Use our services only for lawful purposes - Comply with all applicable laws and regulations - Not interfere with or disrupt the integrity of our services

Property owners using our management services agree to: - Provide accurate property information and documentation - Maintain adequate property insurance - Authorize necessary repairs and maintenance - Pay management fees as agreed in the service contract - Comply with all landlord-tenant laws and regulations - Provide timely responses to management inquiries

Management fees and payment terms are specified in individual property management agreements. Generally: - Fees are calculated as a percentage of collected rent or as a flat monthly fee - Payment is due as specified in your service agreement - Late payments may incur additional charges - We reserve the right to modify our fee structure with appropriate notice

To the fullest extent permitted by applicable law: - Our services are provided "as is" without warranties of any kind - We are not liable for any indirect, incidental, special, or consequential damages - Our total liability shall not exceed the fees paid to us in the preceding 12 months - We are not responsible for actions or omissions of tenants, contractors, or third parties - We do not guarantee specific rental income or occupancy rates

You agree to indemnify, defend, and hold harmless Apex Solutions De Gestion, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from: - Your use of our services - Your violation of these terms - Your violation of any third-party rights - Any claims from tenants or third parties related to your property

Either party may terminate the property management relationship: - As specified in the individual service agreement - With written notice as required by the agreement - Immediately for material breach of contract - Upon mutual written agreement Upon termination, we will transfer relevant documents and funds according to our standard procedures and the terms of your agreement.

All content on our website, including text, graphics, logos, and software, is the property of Apex Solutions De Gestion and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Quebec.

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes by posting a notice on our website or by direct communication. Your continued use of our services after such modifications constitutes acceptance of the updated terms.

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.
